BRIGHT AND BRIGHT – Specialized Legal Consultants – Abu Dhabi in association with KANTARI LAW FIRM - Lebanon, provides legal consultation and services on the following terms and conditions

  1. Lawyer Fees

    2. Lawyers fees are charged per hour or pro rata of the time actually spent. The rates are:

    Partner Lawyers: Dhs  1200,--
    Senior Lawyers: Dhs  1000,--
    Lawyers: Dhs    800,--
    Lawyer Assistants: Dhs    600,--
    Non Lawyer (e.g. interpreters, collectors): Dhs    350,--
    Messengers Dhs    200,--

    All trips outside Abu Dhabi are coordinated with the Client. Traveling days or pro rata thereof are counted as 8 (eight) hours/day or pro rata/day.

    The legal services may be rendered by Partner or Senior Lawyer(s) or Lawyers, who may sub delegate part work to Lawyers Assistant(s) at the Law Office's discretion. "Lawyer Assistants" are lawyers, who are assisting or co-operating with the Partner or Senior Lawyer or Lawyer in charge. Internal brainstorming discussions are charged by one lawyer only or pro rata per head.
    Retainer Agreements, permitting permanent legal advice at lower rates are available on request.

  2. Using Drafts, Specimen etc.

    3. B&B has developed and is continuing to develop a number of specimen of contracts etc. In case such a specimen has been taken for drafting a contract etc. for the client, B&B may add a reasonable amount of time for using such specimen. Based on the assumption, that the preparation of one full page of a draft contract generally requires not less than one hour work for a lawyer, the number of hours actually spent and the number of hours added for starting with a specimen may not exceed the total number of pages of the first draft presented to the Client, excluding time spent for negotiations with the Parties.

  3. Special  Consultations, Services

    4. Fees for special consultations, which due to their nature may require a special fee – agreement, such as registration of trademarks or patents, shall be provided on request.
    Likewise, services related to the incorporation of offshore companies in the Jebel Ali Free Zone, and services as registered agent and / or the provision of the registered office for such offshore companies and registering new companies, are subject to special terms and conditions, which may be provided on request. 

  4. Translations

    The translation fees are calculated by the lines of the translated text at the following rates:                  
    5. From Arabic into English or French; per line: Dhs 8.50
    From English or French into Arabic; per line: Dhs 7.20
    From French into English; per line: Dhs 8.50
    From English into French; per line: Dhs 8.50

    Lumpsum quotations are given on request. Translations requiring a notification will be done by a translation office, licensed by the UAE Ministry of Justice and shall be charged at cost.

  5. Expenses

    Expenses including but not limited to long distance calls, telefaxes, shall be calculated as per customary office rates, which including overheads, excluding petty cash (cf. No. 6 below) , shall not exceed the double amount of the actual cash expenses.
    Traveling expenses, courier or other special services shall be charged at actual expense plus 20% for overheads.


  6. Petty Cash

    7. Petty Cash (e.g. copies, stationary, postage fees, etc.) shall be calculated as per customary office rates. As minimum B&B is charging a lumpsum amount of Dhs 100. -- Per month.

  7. Changes in the Fees and / or Expenses

    8. In case the B&B increases or decreases its fees generally for all clients, such increase or decrease shall be given with a one –month notice and shall become effective to the end of that month.

  8. Miscellaneous

    9. The legal services and all expenses related thereto will be charged at the end of each Gregorian month based on time slips of the respective lawyer(s) and on vouchers approved by the Lawyer(s) in charge. The monthly Statements of Account are prepared on computer basis and will be sent to the address given by the Client. In consideration of the mutual trust which is paramount for the relation between the B&B and its Clients, the Client accepts the calculation of B&B as true and correct, unless obvious mistakes are evident. Details of calculation including but not limited to the charges as set forth herein will be given on special request free of charge which, however, does not entitle the Client to postpone payment. Time used for extended reports shall be considered as part of the legal services. B&B may at its sole discretion request a deposit equal to the estimated average or expected legal work for up to two months.

    Notwithstanding the deposit and without prejudicing any further right(s), B&B may stop providing legal consultation if any payment is delayed by more than six weeks starting from the date of a Statement of Account.

  9. General Terms & Conditions for Legal Services of B&B

Unless different terms and conditions have been agreed upon in writing in an individual case, the following terms and conditions shall apply to all legal services referred to B&B:

    1. All services will be performed with the care of an ordinary attorney according to the rules of professional ethics applicable to Lebanese attorneys. The subject of the mandate is the agreed service, not any particular success and / or the completion of a particular work.
    2. Tax advice and advice on foreign law outside of the GCC – Countries are only included in the services / representation if expressly agreed upon in writing. Statements or information given orally (in person or over telephone) are only binding if confirmed in writing by B&B.
    3. Legal statements, opinions, specimen and other legal works remain the intellectual property of B&B.  The passing on of such written or electronically stored legal works to third parties, others than to persons connected to the facts and circumstances of a particular case, requires the prior written consent of B&B.
    4. If the law changes after the completion of services (date of closure of the file or date of final invoices), there shall exist no duty of B&B to inform the client of such change or of the consequences of such change.
    5. The attorneys or B&B shall be liable for damages caused by them in cases of intent or gross negligence, and such liability shall be restricted to actual losses or damages, excluding indirect or consequential damages, and be limited to an amount of maximum 1000000 DHS.
    6. Claims for damages can only be made within six months after getting access to the facts of the damage and the events justifying such claim, at the latest, however, within three years after the claim arose or within three years after the end of representation (date of closure of the file or date of final invoice), (preclusive time limit), whatever occurs earlier. The claim shall deemed to be extinguished if legal action is not brought within six months after receiving a written refusal to provide compensation .The right to rely on the statute of limitations as a defense remains unaffected.
    7. The attorney – client relationship and the claims resulting there from are governed exclusively by the laws of the United Arab Emirates.
